During the presentation, the conditions for using so-called beauty claims will be discussed from the perspective of legal provisions, case law, and guidelines.

The control of dietary supplements containing mushrooms includes requirements for commercial and health quality. Regarding composition, the status of the ingredient used in production is particularly important. In terms of labeling and advertising, the challenge lies in communicating health benefits while minimizing the risk of regulatory objections. The lecture will present key legal principles and practical guidelines for businesses.

Entities marketing dietary supplements are regularly surprised by resolutions issued by the Dietary Supplements Team, which establish limits on the content of vitamins and minerals. These resolutions do not specify the date from which they take effect, yet sanitary inspection authorities (PPIS) challenge the composition of products introduced to the market before the resolutions were issued. During the presentation, I will outline the arguments that can be used to respond to the inspection’s objections.

Health claims have been a challenge for companies for many years. This issue is also a focus of regulatory inspections, which actively verify claims and impose heavy fines in case of non-compliance.
Recently, much has been happening around pending claims. The European Parliament has requested the European Commission to review and either approve or reject these claims, while the Court of Justice of the European Union is examining cases related to them.
The evolving regulatory landscape significantly impacts the dietary supplements market. How will legal changes concerning health claims affect the industry? I will discuss the future of health claims during my presentation!

Piotr Zawadzki, legal advisor and patent attorney at Bird & Bird. For over 17 years, he has been supporting clients from the most innovative sectors of the economy, such as the pharmaceutical and food industries, media, advertising, IT, and others. He has extensive experience in elemental composition analysis across a wide range of products, including food, environmental, and pharmaceutical samples. A dietitian at the Institute of Sustainable Nutrition; academic lecturer at the Medical University of Warsaw (WUM) and the University of Health Sciences (USM); for many years an expert at the Institute of Food and Nutrition and the National Institute of Public Health PZH-PIB, as well as the head of the National Center for Nutritional Education. Co-author of numerous publications and guides on the role of nutrition in the prevention and treatment of diet-related diseases. Author of dietary recommendations in the form of a plate model and the material "Three Steps to Health." She is involved in the development and dissemination of dietary guidelines, coordination and evaluation of nutrition education projects, assessment of nutritional status and dietary habits, academic teaching, nutrition consulting, and science popularization.
